Terms of Service

These Terms of Service (“Terms”) govern your access to and use of OpenComment AI (“OpenComment”, “we”, “us”, or “our”), including the website at opencomment.ai, our browser extension, and related services (collectively, the “Service”).

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and capable of forming a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

OpenComment provides tools to monitor publicly available LinkedIn activity, receive notifications, and generate AI-assisted comment suggestions for B2B engagement workflows. The Service does not require your LinkedIn login credentials and does not post on your behalf without your explicit action.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized access or security breach at [email protected].

You agree not to:

• Use the Service to violate LinkedIn's terms, applicable laws, or third-party rights
• Send spam, harassment, or misleading content through suggested comments
• Attempt to reverse engineer, scrape, or overload the Service
• Share account access outside your authorized team members on applicable plans
• Use the Service to collect or process sensitive personal data without lawful basis
• Misrepresent your identity or affiliation when engaging on LinkedIn

We retain all rights in the Service, software, branding, and documentation. You retain ownership of content you create. You grant us a limited license to process your data solely to operate and improve the Service.

You own the data you input and the outputs generated for your workspace, subject to third-party platform terms (including LinkedIn). Upon request or account closure, you may export available workspace data during the retention window described below.

The Service integrates with third parties such as Stripe, LinkedIn (public data only), Slack, and cloud infrastructure providers. Your use of those services is subject to their respective terms.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE SPECIFIC ENGAGEMENT, LEAD, OR REVENUE OUTCOMES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENCOMMENT AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You may cancel at any time through your billing portal. We may suspend or terminate access if you breach these Terms or if required for security or legal compliance. After termination, account data is retained for 30 days unless you request earlier deletion, after which it is removed subject to legal retention requirements.

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which OpenComment is incorporated, without regard to conflict of law principles. Disputes will be resolved in the courts of that jurisdiction unless otherwise required by applicable consumer protection law.
